Agreement to Terms

These Terms of Service govern your access to and use of the BrewCraft website located at brewgear.shop, including any related services, content, and products offered by BrewCraft. By accessing or using the Site, you accept and agree to be bound by these Terms. If you do not agree, please do not use the Site. We reserve the right to update these Terms at any time without prior notice; your continued use constitutes acceptance of changes.

Account Registration and Responsibilities

When creating an account on brewgear.shop, you must provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use at [email protected]. We are not liable for any loss or damage arising from your failure to protect your account. We may suspend or terminate accounts for violations of these Terms.

Payment Terms and Processing

All purchases on brewgear.shop are processed through third-party payment service providers that comply with PCI-DSS standards. BrewCraft does not directly collect, store, or have access to your full payment card details. By completing a purchase, you authorize the payment method you select and agree to pay all applicable charges, including taxes and shipping fees. Payment-related disputes must be handled according to the procedures of the respective payment channel. We may change payment processors without prior notice, and we are not responsible for errors or delays caused by third parties. Refunds are issued per our Return and Refund policy.

Shipping and Returns Policy

We offer a 35-day return window for most items from the date of delivery, which extends beyond the standard consumer right of withdrawal in certain regions. To initiate a return, contact us at [email protected] within 35 days. Items must be unused, in original packaging, and you may be responsible for return shipping costs unless the item is defective. BrewCraft is not liable for shipping delays caused by carriers or customs.

Intellectual Property Rights

All content on brewgear.shop—including text, images, logos, graphics, product designs, and software—is owned by BrewCraft or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent. Unauthorized use may result in legal action. Trademarks of third parties referenced on the Site remain their property.

Disclaimer of Warranties

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO DISCLAIMERS MAY NOT APPLY TO YOU FULLY.

Limitation of Liability

To the fullest extent permitted by applicable law, BrewCraft, its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of products, including but not limited to loss of profits, data, or business interruption, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount paid by you for the product giving rise to the claim. This limitation applies regardless of legal theory.

Dispute Resolution: Arbitration and Class Action Waiver

Mandatory Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved exclusively by binding arbitration administered by a neutral arbitrator in Multnomah County, Oregon, and not by a court. You agree to waive any right to a jury trial. The arbitration shall be conducted in English, and the arbitrator's award may be enforced in any court of competent jurisdiction. This clause does not preclude filing a claim in small claims court if eligible.

Class Action Waiver

YOU AND BREWCRAFT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING. Claims may not be consolidated. If this waiver is found unenforceable, the arbitration clause shall be void as to that dispute. This waiver does not apply to claims that cannot be waived by law.

Governing Law and Jurisdiction

These Terms and any disputes shall be governed by and construed in accordance with the laws of the state of Oregon, United States, without regard to conflict of law principles. You consent to the exclusive jurisdiction and venue of state and federal courts located in Portland, Oregon, for any actions not subject to arbitration. Our products are offered only in jurisdictions where they comply with local laws; we make no claim regarding compliance elsewhere.
